Category rules that change what an Australian UGC video can say

Australia has one rule that catches many international brands. Under the Therapeutic Goods Advertising Code, people who are paid or receive a benefit cannot give testimonials for therapeutic goods, which covers many supplements, sunscreens, and health devices. A paid UGC testimonial for those products is not a format you can run here, so brief demonstration or education content instead and check the product category with the Therapeutic Goods Administration guidance first.

For every other category, the Australian Consumer Law prohibits misleading or deceptive conduct, and the ACCC has said that ads presented as genuine reviews must be genuine. The AANA Code of Ethics requires that advertising be clearly distinguishable as such. Give the creator an approved claims list, review the script before the shoot, and label the content as advertising wherever it runs.

Usage, ABNs, and GST for Australian UGC

Agree where and how long the content can run, whether it may be used as TikTok Spark Ads or Meta partnership ads from the creator handle, and whether it covers Australia only or New Zealand as well. Many brands run a single creative library across both markets, which is a separate usage right from Australia alone.

Australian creators invoice with an Australian Business Number. Those whose GST turnover is A$75,000 or more must register for GST and include it on their invoice, so ask whether a quote is GST inclusive and confirm the current threshold with the Australian Taxation Office or your accountant.

Frequently asked questions

Can a paid creator give a testimonial for a supplement in Australia?

Generally not. The Therapeutic Goods Advertising Code prohibits testimonials from people who are paid or given a benefit for therapeutic goods, which includes many supplements and sunscreens. Check the category with TGA guidance first.

Do Australian UGC creators charge GST?

Those registered do, and registration is required once GST turnover reaches A$75,000. Ask for the creator ABN and whether each quote is GST inclusive.
