UGC testimonials and UK consumer law

Since April 2025 the Digital Markets, Competition and Consumers Act has made fake reviews and concealed incentivised reviews banned practices in the UK, with the Competition and Markets Authority able to fine businesses directly. A UGC video that presents a paid creator as an ordinary customer is exactly the format that rule targets. Brief creators to speak from real use of the product, keep the evidence that they received and used it, and never cut UGC into a review carousel as though it were organic feedback.

The CAP Code still governs the claims in the video. A London creator saying a serum cleared their skin is a claim the brand has to be able to substantiate, whether the video runs on the creator handle or as a brand ad, so send the approved claims list with the brief and review the script before filming rather than the edit after it.

Usage rights, music, and paying London creators

Write usage into the order: where the content may run, for how long, whether it may be used in paid ads from the creator handle through Meta partnership ads or TikTok Spark Ads, and whether that usage covers the UK only or other markets too. Trending sounds are a common trap, because most commercial music on TikTok and Instagram is not cleared for ads, so ask for a version on licensed or original audio.

Most London UGC creators trade as sole traders. Those whose taxable turnover passes the VAT registration threshold, £90,000 a year since April 2024, will add VAT to their invoice, so ask at the quote stage and confirm the current threshold with your adviser.

Frequently asked questions

Can UGC be used as a customer review in the UK?

Not if the creator was paid or gifted and that is hidden. The Digital Markets, Competition and Consumers Act bans fake and concealed incentivised reviews, so label paid UGC as advertising and keep it out of review sections.

Do I need extra rights to run London UGC as Spark Ads or partnership ads?

Yes. Running content from the creator handle is a separate permission from owning the file, so name the ad formats, the territory, and the usage period in the contract.
